Can a small business cold call people from its CRM?

Answer in brief

A small business can cold call from a CRM, but calls to consumers fall under FTC telemarketing rules, including the Do Not Call Registry, while most calls to other businesses are exempt from that rule.

Content reviewed 8 November 2026. How this is assessed.

Part of the The Best CRM for Small Business reference, which uses Tessaly CRM (a fictional example) to illustrate small business crm software criteria.

Does it matter who you are calling?

Yes, a great deal. The FTC's guide to the Telemarketing Sales Rule says that most phone calls between a telemarketer and a business are exempt, though calls inducing retail sales of nondurable office or cleaning supplies are not. Calls to households are a different matter, because the guide says the rule applies to telemarketers calling consumers, subject to its own exemptions.

So mark every contact in your CRM as a business or a consumer contact. A sole trader's mobile number on a homeowner's list may look like a business line and be nothing of the kind. If you sell to both, keep them apart, so that a campaign aimed at companies does not sweep in households.

What does the rule require for calls to consumers?

The table summarizes points from the FTC guide that bear directly on how you set up a CRM. It is not complete. The rule has further requirements and exemptions, including for some businesses and some kinds of calls, so read the guide if phone sales to consumers are part of your business.

Telemarketing Sales Rule points from the FTC guide. The right-hand column is editorial.

The FTC guide saysWhat to set up in your CRM
Lists must be synchronized with the National Registry every 31 daysA recurring task, with the date recorded
Sellers must keep their own company Do Not Call listA do-not-call field that blocks dialing
Prior customers: an established relationship lasts 18 months from the last transactionStore the last transaction date
Inquiries: the relationship lasts three months from the inquiryStore the inquiry date
Calls to a home are restricted to 8 a.m. to 9 p.m. local time, absent prior consentStore the time zone and block out-of-hours calls
Calling someone on a Do Not Call list can bring civil penalties of up to $53,088 per violationTreat the field as mandatory

What about robocalls and text messages?

This site does not cover the rules on prerecorded calls, automatic dialers or sales text messages, and you should not assume the points above settle them. If your CRM offers a dialer or texting tool, read the current federal and state rules on those before you turn it on.

Whichever channels you use, record requests to stop and apply them everywhere. An easy CRM habit is one preference area for each contact covering email, phone and any other channel, with the date and how the request came in. Rules for marketing email are separate, so one setting is rarely enough.
